Kathleen Covert-Mininno, Esquire
Kathleen began her legal career
in private practice before moving to the Camden County Prosecutors
office as an Assistant Prosecutor in 1995.
Initially, she spent time in the prosecutors criminal
motions’ section where she handled suppression hearings on behalf
of the State of New Jersey. These
motions involved illegal searches, illegal seizures and probable
cause issues under the 4th and 5th
Amendments of the United States Constitution. She handled motions
involving Miranda and voluntary confession issues.
She also represented the State of New Jersey in bail and
sentencing motions. Finally,
while in this unit, she represented the State of New Jersey in
appeals filed from the municipal courts.
Thereafter, she spent time in the
prosecutor offices’ trial unit where she tried jury
trials in various criminal matters.
Those trials included drug distribution, criminal
eluding and sexual assault.
Eventually, she was assigned to
the prosecutor office’s grand jury unit.
There she screened thousands of criminal cases filed in
Camden County. In
this unit, she worked closely with police officers from every
local municipality in Camden County.
Since leaving the prosecutors
office and beginning private practice she has represented clients
both at the Superior Court and County level and in the Municipal courts in South Jersey.
Those cases include:
- Driving Under the Influence;
- Assault;
- Traffic offenses;
- Drug Possession, Delivery, and Distribution; and
- White Collar Crime
- Post Conviction Sentence Reductions Federal and State
Kathleen has a unique legal
philosophy: “The best defense is a good offense.†Her experience as a career prosecutor has led her to believe
in the importance of being proactive early in the criminal
prosecution process. For example, when representing clients in
traffic courts, she counsels clients and explains how they can be
proactive in restoring license or insurance privileges before the matter
comes to court. In
criminal cases, she explores the client’s unique mitigating
facts and circumstances early in the process and communicates them
to the prosecutors who are prosecuting the case.
This strategy helps the prosecuting authorities to consider
the person who has been charged with a crime and not just the
crime that has been alleged.
She understands that if a person
has been accused of a crime, the early decisions they make can
literally affect the rest of their life. She believes that the
strength of a client’s defense should be assessed by an attorney
who fully understands the unique facts of your case and who knows
how the law applies to your circumstances.
