Protect the Elderly: Support the 2008 Fairness in Nursing Home Arbitration Act

This week, the Senate Special Committee on Aging will hear arguments regarding the "2008 Fairness in Nursing Home Arbitration Act" (S. 2838). This act would eliminate pre-dispute binding mandatory arbitration (BMA) clauses in nursing home contracts. Without this legislation, senior citizens will be denied the right to a jury trial in the event of abuse or neglect. Nursing homes will also avoid public accountability and exposure for such abuse, as arbitration hearings are kept private and confidential. Jury Awards Nearly $800,000 in Medical Negligence Suit

Today, October 23, 2006, a Camden County jury found in favor of The Family of Mr. Robert Boylan in a medical malpractice suit. The defendants were B. Dawson, Shoemaker, M.D., Joseph Szgalsky, M.D.and Megan Vermeulen, M.D. The jury found both Dr. Shoemaker and Dr. Szgalsky responsible. The jury awarded nearly $800,000 in damages.
