Elder Abuse Lawyers Congratulate Activist for Winning ‘Genius’ Grant

On Tuesday, September 20, 2011, The John D. and Catherine T. MacArthur Foundation awarded Marie-Therese Connolly their $500,000 “genius grant.” According to the MacArthur Foundation, Connolly has “devoted her career to laying bare the many forms of elder abuse: physical and psychological, as well as financial exploitation and wrongful deprivation of rights.” As elder abuse lawyers , we were very happy to hear about the recognition of someone who has spent her career fighting for those who can no longer fight for themselves.

Marie-Therese Connolly, a former Department of Justice lawyer, recently said in an interview,

“I was shocked that the problem is so invisible…There is so much opportunity for change, and I can’t think of another issue that affects so many people and where less is being done.”

She has worked tirelessly for years hoping to change the problem of elder abuse. She has written, lectured, testified before Congress and been instrumental in creating laws that help protect the elderly. In the late 1990s, Connelly was put in charge of the Elder Justice and Nursing Home Initiative that was created by the Clinton administration. She was the inventor of the Elder Justice Act which Congress passed last year and the founder of Life Long Justice, a non profit organization aims to fight elder abuse.

“It should be a part of the national conversation like health care, justice and jobs… I’m just hoping that the foundation’s recognition of what’s really a growing epidemic is the beginning and will be a game-changer in the whole field,” Connelly said.

Hughes, her boyfriend, and her two children moved into the home of the victim five years ago so Hughes could begin caring for the woman who has multiple sclerosis and has been bedridden for two years. When a visitor recently came to the house, the elderly woman asked that person to take a picture of her back. When the victim saw how bad the bedsore on her back was she asked to be taken to the hospital. At the Tucson Medical Center they discovered that the bedsore was open to the bone. The victim weighed 90 pounds and needed a blood transfusion.

When the police began to investigate Hughes, they discovered that the home was littered with garbage, maggot infested rotten food, dog feces, urine, and vomit. The victim told police that Hughes gave her one sponge bath a week, only allowed her to drink one and a half quarts of liquid a day (so she would not have to use the bathroom), and only fed her between 700 and 1,000 calories per day. She said that she had only been outside twice and had not seen a doctor in over a year. She kept a diary of all of the abuse that she suffered under Hughes’ care. Hughes and her family were evicted from the victim’s home and all power of attorney privileges were revoked. She is facing charges of elder and child abuse as well as suspicion of unlawful imprisonment and emotional abuse of a vulnerable adult. The victim saw an opportunity to save herself from the abuse she was suffering and took advantage of it.

Granddaughter Gets Arrested for Exploiting and Stealing from Elderly Relative

Hutcheson is being accused of stealing almost $12,000 from her 100-year-old grandmother’s bank accounts in just a few months. She is being charged with grand theft, 39 counts of criminal use of personal identification and exploitation of the elderly. Hutcheson moved in with her mother and grandmother in April and started stealing from her within weeks. After a July 20 incident at Score Credit Union bank where she withdrew funds without authorization, an investigation looked into Hutcheson. They discovered that Hutcheson would drive the victim on daily errands to pick things up for her and used her grandmother’s credit cards. She would also get a large amount of money out of the bank, buy small items for her grandmother and then save the rest of the money for herself. The bank contacted the victim’s family when the account was overdrawn and the situation became so bad that the missing money was originally reported by Hutcheson’s mother.
