Staff Member Steals $28,000 from 94 Residents

The administrators of the Village Green of Waterbury discovered the theft in October. According to administrator Linda Garcia, the nursing home’s account manager had full access to the resident’s accounts. When a resident requested a withdrawal, she would make the withdrawal for more than the amount requested and keep the difference.

“We asked her for an explanation. When she couldn’t provide one, we terminated her,” said Garcia.

The nursing home is currently in the process of reimbursing all of the residents. According to an inspection report by the state Department of Health, “money was withdrawn from cognitively impaired residents’ accounts without the responsible parties’ consent.”

The facility is also guilty for another incident of nursing home abuse. In June of 2011, a nurse’s aide slapped a resident on the shoulder in order to wake him up and yelled “get out!” The resident happened to be the president of the resident’s council and reported the incident. There was an internal investigation held by the nursing home and the nurse’s aide was fired.

Woman Arrested Twice for Stealing and Cashing Checks

elder abuse lawyers in NJ and PA Edna Lena Morales, 48, was arrested for the second time on Wednesday, November 9, 2011 for suspicion of elder abuse, forgery and possession of stolen property. She was arrested for the first time on October 17, 2011 after an investigation of her cashing several checks that belonged to an 83-year-old woman. The woman’s bank contacted her in September about the checks and she told them that Morales worked as her housekeeper, cleaning and cooking meals a few times a week. The elderly woman confronted Morales and she agreed to pay the money back. She wrote a check for $4,000 but the check bounced. Police also believe that Morales used the woman’s credit card charging more than $1,200, but Morales told them that the woman gave her permission to use the credit card.

A week later, a second woman went to the police to report that Morales cashed one of her checks for the amount of $5,000 leading to her second arrest. She is currently being held at the Merced County Jail on $130,000 bail.

The Golden Years Rest Home in Jenkins, KY is facing problems after their former administrator James F. Tackett, 69, entered a guilty plea in court for stealing thousands of dollars in funds from the home and from the residents. He admitted to stealing more than $300,000 from the home that was meant to be used for the care of the patients. He also admitted to stealing more than $60,000 from one resident. Tackett used the money to buy himself cars and other personal vehicles including a GMC Hummer, a Chevrolet Silverado, a Ford F-150, and a Suzuki XL-7. He is also in trouble for not reporting any of the funds on his state income tax returns for the past five years.

This started after a complaint was filed in 2009 by the local ombudsman office that multiple residents of the home were not receiving their $250 stimulus check from the American Economic Recovery Act, The Attorney General’s Department of Criminal Investigations started looking into the home. This is not the first strike for Tackett, he plead guilty in 2009 to physical abuse of a resident and in October to charges of theft of federal Social Security funds received on behalf of the personal care home residents. He faces up to 10 years in prison for the state charges.

Timothy Ralph Carrillo, 49, has been convicted by a California jury and sentenced to 35 years in prison for stealing more than $100,000. Carrillo has been convicted of 24 counts, including financial elder abuse, residential burglary, grand theft and contracting without a license. From 2006 to 2008, Carrillo convinced nine people, mostly elderly with some in their 80s, to pay him in advance for home repairs such as painting, window replacement, and roofing. He then disappeared and never did any of the promised repairs. The victims testified during trial that their losses ranged from $1,260 to $65,000. One of his victims borrowed $65,000 on an equity credit line and was told by Carrillo to pay $50,000 to his “partner” for supplies. But the third man was actually someone Carrillo owed money for a gambling debt.

Carrillo has prior felony convictions for commercial burglary, grand theft, driving under the influence, and obtaining money by false pretenses. Because of his record and California’s three strikes law, Carrillo’s sentence was twice as long as what it would have been. According to Judge Russell Scott, “Based on the defendant’s character … he does clearly fit the purpose of the three strikes law.” Judge Scott went on to tell Carrillo “You’re a predator. I don’t know if anybody’s ever said that to you…Here you are preying on the elderly … and you don’t care.” Carrillo was convicted in 2009 in Texas of similar cases of cheating the elderly and sentenced to 25 years in prison. He will serve his 35 years in California after he has completed his time in Texas.

He also used two of the home’s credit cards to purchase personal items including a computer, books, personal cell phone, meals, vehicle repairs and fuel totaling $28,080.05. He is facing more than ten years in prison if convicted of these charges.

Elder Abuse Through Abduction and Theft of Life Savings

Barbara Davis and Nicholas Davis, 41, and their 20-year-old godson, Jonathan Stevens have been charged with the felony of endangering the welfare of an elderly dependent adult. The group allegedly used the woman for her money and then left her when the money ran out. She was found undernourished, disoriented, very thin, and robbed of her entire life savings.

The woman sold her Los Angeles home in 2008 for $600,000 and moved into an apartment where she met the suspects. In 2009 they told her that they wanted to take her on a road trip and one day carried her into a car. They held her captive for more than two years using her for her money. According to Det. Robert McFetridge, who is investigating the case:

“They knowingly left her in a small cabin with no telephone and very little food… They left her to her own devices to take care of herself in 93-degree heat…Every time I talk to her, she slowly comes out of her shell. They exploited her, isolated her from the world, they controlled what she saw, what she heard and who she talked to. This is a textbook case of elder abuse and financial exploitation”

The suspects took advantage of a lonely elderly woman with no family for their own personal gain and left her with nothing. This is an extreme example of how little some people think of the elderly. Once they were done exploiting her for her money, they literally abandoned her to die. The three suspects were released on bail and are scheduled to appear in court on September 29 to face charges.

Caretaker Forges Checks Totaling $300,000

elder abuse in NJ and PAMarisa Robles, 31, faced 92 counts related to theft, fraud and elder abuse and pleaded guilty to 32 counts of fraud and elder abuse this month. Robles used her access to the 81-year-old man’s financial documents to write checks to herself and sign his name. According to Deputy District Attorney Barrie Pink, “She started small to see if she could get away with it,” first forging checks for $500 but then quickly began writing them for larger amounts up to $10,000. Robles stole up to $300,000 from the elderly man.

Robles was not just stealing from the man’s personal accounts. The victim has a foundation that gives money to help less fortunate girls in third would countries to better themselves through education. “She stole from him, and she stole from what his foundation does,” said Pink.

After her arrest, Robles kept saying, “Can’t I just pay it back.” But by the time of the arrest, Robles did not have any of the $300,000 left. At an August 17th hearing, Robles will be asked to repay all the money she took.
