Bed Sore Attorneys – CA Lawsuit Shows Typical Medical Center Conduct

Bed Sore AttorneysThe family of Esperanza Garcia has recently filed a complaint in Los Angeles County Superior Court following her death in October, 2010. Garcia’s daughter, Irene, is seeking general and special money damages as compensation for her mother’s pain and suffering, as well as costs and fees associated with the litigation. The complaint alleges that the Los Angeles Medical Center was reckless in their treatment and care of the ill woman. Esperanza was extremely ill when she entered the medical facility but she did not suffer from any bed sores or pressure ulcers at the time she entered the center. The bed sore attorneys said that once the bed sores began developing on the 64 year old woman, the personnel at the center did not report the severity of the ulcers or properly treat them.

Death Resulted Only One Day Following Removal From the Facility

The medical center should have been on notice that the elderly woman was at significant risk to develop bed sores because of the likelihood of skin breakdown. The center failed to follow any means of prevention in order to limit the possibility of bed sores. Not only did Garcia’s open wounds go untreated, she was also forced to continue to lie on them. Even worse, the woman was left uncared for in her own excrement for extended periods of time as the sores intensified. The bed sore attorneys found that rather than show the proper medical records, center officials deliberately covered up the documented pressure sores and attempted to re characterize them as merely a skin rash. Following this neglect, the family removed Garcia from the medical center but her condition had worsened beyond treatment and she passed away only a day later. Bed sore attorneys believe that this type of neglect and failure to understand the seriousness of bed sores is more prevalent than most would believe.

Nursing Home Neglect Causes Woman to Fall to her Death

Unfortunately, falls are not uncommon in nursing homes. Patients often fall out of bed, in the shower, or just from lack of balance. Nursing home neglect is a serious issue that can lead to severe injuries or even death. Falls are terrible accidents for the elderly and their families, but there are things nursing homes and long-term care facilities can do to prevent them from happening.

Alzheimer’s Patient Climbs Out Window

new jersey philadelphia Nursing Home Neglect woman falls Springfield Skilled Care CenterOzarksFirst.com reported, in Springfield, Missouri, about a woman with Alzheimer’s who fell from a window of the Springfield Skilled Care Center where she was living. Mary Bebee was 81 years old and living in a secured unit of the facility. According to Cpl. Matt Brown of the Springfield Police, “It appears she tried to crawl through the window, attempted that, and at some point expired.” Ms. Bebee fractured her neck and died because of the fall.

The Springfield Skilled Care Center has had previous issues with inspections. The nursing home has been cited for violations in the past year including failure to prevent falls, failure to properly refrigerate some of their medications, safety code violations in the special care unit and fire doors not opening properly when fire alarms were tested. According to the Medicare Nursing Home Compare System, Springfield Skilled Care Center ranks one out of five stars in terms of health inspections, which is well below average.

Accidents like this one can be prevented. Patients with Alzheimer’s and dementia need to be watched more carefully because they can be unpredictable. These residents should not be given the opportunity to hurt themselves in this way. Windows should be securely shut, sharp objects should not be left out and nursing home staff should be present for daily tasks such as bathing and eating. Alzheimer’s and dementia patients are especially vulnerable and need a specialized form of care.

Bed Sore Lawyers: Nutritious Diet Key to Recovery

Bed sore lawyers believe that patients who suffer from pressure ulcers need to meet with a dietitian as soon as possible. In association with a licensed dietitian, patients can determine the best diet for supporting healing and promoting recovery. Many elderly people who suffer from bed sores likely do not receive the proper nutrients daily. A malnourished individual who does not get a recommended daily diet lacks the capacity to synthesize protein in order to repair tissue.

Questionnaire and Examination Generally Assist in Prescribing an Adequate Diet

new jersey philadelphia bed sore lawyers Nutritious Diet Key RecoveryThrough a series of questions and a physical examination, a physician can get a better sense of the strength and nutrition an individual is receiving. After the test, if the doctor believes that a patient may be malnourished, tests should be run to monitor the serum albumin and lymphocyte counts. Dietary supplements and nutrients should be prescribed for a patient who is at risk for malnutrition. Possible supplements and nutrients can include Vitamins A, B, C, and E, arginine, glutamine, magnesium, selenium, manganese, and zinc, among others. If a patient is assigned to take these vitamins and minerals, it is imperative that a physician’s instructions are strictly followed. Bed sore lawyers believe that the strength of these minerals and vitamins can lead to severe issues regarding health if they are taken in improper dosages. They also believe that high protein diets increase the speed and effectiveness regarding pressure ulcers.

Everyone, regardless of age, should engage in healthy eating to ensure that they are receiving adequate vitamins. This sort of healthy lifestyle and diet is even more important in those who suffer from bed sores because it takes a healthy body to combat these ulcers and infection.

Nursing Home Neglect Can be Caused by Poor Working Conditions

With the nation’s elderly population increasing to an all time high, nursing home neglect is becoming a bigger problem than ever before. More direct care workers are needed to staff the nursing homes and long-term care facilities to keep up with the growing number of residents. Quality employees are in high demand and it is more important than ever to make sure that their working conditions are acceptable. This is a demanding and often thankless job, and unhappy employees can be the beginning of the nursing home neglect cycle.

Unsatisfied Employees can have Fatal Consequences

Nursing Home Abuse NJDirect care workers spend the most time with the nursing home residents. They are responsible for the daily tasks such as feeding, changing, and bathing and are frequently the most under appreciated of the nursing home staff. They often make low hourly wages without benefits and have little say in the actual care of their patients. Many direct care workers feel disrespected by their superiors. This anger is often taken out on the residents through direct abuse or neglect.

By giving these employees significant responsibilities, they will take more pride in their work and abuse and neglect will decrease. Making the direct care workers feel valued will improve overall care. Nursing homes and long-term care facilities need to implement a standard of care with their staff. Knowing exactly what is expected of them will eliminate careless mistakes. Investing in the employees through training and open communication about the care of the residents will make the staff feel more prepared and respected. These policy changes will improve the general work environment of the direct care workers and will hopefully lower the risk of neglect of the residents they care for on a daily basis.

Nursing Home Neglect of Oral Health Leaves Woman Gravely Ill

Nursing home neglect can affect many areas of care. One often overlooked area is oral hygiene. Oral health can affect the overall health of the already at risk population and there is little dental care in place in many of the country’s nursing homes. But dental care is starting to get better and they are even offering their patients Invisalign in Calgary.

A resident of a Kentucky nursing home contracted a potentially life threatening gum infection because the staff failed to remove her dentures for six months. A staff member was told of the woman’s dentures when she was admitted, but it was never noted in the chart. From there on out, the teeth were believed to be natural. The dentures were never removed or properly cleaned in the six months she had been under the nursing home’s care. It wasn’t until the resident’s face started to swell that she was examined by a dentist, who discovered that the dentures were corroded and had not been cleaned in quite some time.
The nursing home was issued a Type A citation, which qualifies an event as an immediate threat of death or injury to a nursing home resident. The home lost federal funding and has been temporarily shut down. The residents have been transferred to other facilities.

Oral Health Affects Overall Health

new jersey philadelphia nursing home abuse lawyers Oral Health Woman Gravely IllMany nursing home residents have physical and psychological disabilities that make caring for themselves difficult or impossible. These residents need the staff to be attentive to thinks like oral care in order to prevent the physical complications that can result. Eating less and losing weight is one problem associated with poor dental care, something that can cause severe problems in the elderly.

Better oral care is desperately needed in many nursing homes and can easily be improved upon. Training the facility staff in dental hygiene is one small change that can significantly enhance the care of your loved ones. Long-term care facilities are required by law to follow certain guidelines and protect the health of their residents.

Nursing home neglect lawyers always recommend frequent and unscheduled visits to the facility where your loved one resides. The best way to be aware of the kind of care the home provides is to show up often and unannounced. Advocate for your loved one’s quality of life by doing what you can to improve it. Nursing Home Abuse Exposé: Burlington Woods

Today we once again expose a New Jersey nursing home with a below average rating according to Medicare’s Nursing Home Compare. This website compares and rates nursing homes across the country and, as New Jersey and Philadelphia attorneys with expertise on nursing home abuse and neglect cases, we find this website an important resource. Today we will discuss a nursing home in Burlington County that has been given a 2 out of 5 star rating by the official Medicare website.

Burlington Woods: Not the First Time We’ve Written About Them

nj and pa nursing home abuse attorneysBurlington Woods is a nursing home with 227 long term beds. It is also a for profit, corporately owned and run nursing home. According to the New Jersey Division of Health Facilities Evaluation and Licensing, Burlington Woods was routinely inspected on two separate occasions between December 2008 and November 2010. During those inspections, Burlington Woods was cited for 12 separate deficiencies. It was found that the facility failed to make sure the nursing home was free of dangers that cause accidents. Burlington Woods also failed to keep the rate of medication errors to less than 5%. Additionally, it was determined that Burlington Woods failed to write and use policies that forbid mistreatment, neglect, abuse , and theft.

Burlington Woods was also inspected 9 additional times, based on complaints. This led to another four citations. These inspection results are a part of why this nursing home received an overall below average rating by Medicare. Again, these types of issues are those that can lead to abuse and neglect in a nursing home. The fact that there wasn’t a policy in place regarding how the patients should be treated to stave off abuse and neglect is, itself, very disconcerting. This is the type of nursing home that may lead to injuries and health issues such as overdoses, malnutrition, and bed sores. We urge all individuals to carefully review any nursing home before placement in order to assure a safe environment for their loved one.

Nursing Home Abuse a Growing Trend

nursing home abuse and negligence in long term care facilities
Reported cases of nursing home abuse are on the rise.

The Hampton Roads News recently published an article discussing the results of a study on nursing home abuse. The study asserts that elderly citizens are being abused more than ever before.
Study results are only helping the fight to improve nursing home and long term facility care.

Within the study are statistics that illustrate a 9 percent rise in reported cases of nursing home abuse from 2008-2009. From 2007-2009, reports rose 19 percent.
A personal account in the study involved the story of an 87 year old Alzheimers patient that died in the hospital after being brought in covered in bruises and bedsores or pressure sores, and suffering from extreme malnourishment.

Experts believe that these numbers are poised only to rise.

Never let Nursing Home Abuse go Unreported

Considering that thousands of nursing home abuse cases go unreported, perhaps a rise in these numbers would be good for the fight against inattentive and abusive care.
Reporting nursing home abuse to the state ombudsman will trigger an investigation, making it hard for nursing homes and long term care facilities to continue treating residents with such callous disregard.

Contacting a nursing home abuse attorney in the event of elder abuse is also essential. Nursing homes tend to provide inadequate care because their staff is overworked and underpaid, or perhaps not trained or properly educated. Owners of these homes cut staff numbers, sometimes below regulatory standards, to raise profits.

In the end, our elderly loved ones are suffering so someone else can get rich. Recently, juries have been awarding huge sums of money to victims of nursing home abuse. It’s clear that the crime is intolerable and offenders must be punished.

Tort Reform is Hurting More Than Helping

As the health care debate continues, so does tort reform. While some efforts have been made to help protect patients and their rights, there is still tort reform that is trying to cut costs and because of this there are still many people that are unable to get proper medical care and unable to fight for their rights to it. If tort reform continues the way it has, it is hurting more people than it is or will help.  Cutting costs and providing coverage for everyone is a great idea, but it is only great if it actually helps people to get the care they need and to have the services they need to fight for proper medical care if it is not given.  They are still many people being injured daily because of medical errors and malpractice. They are still many elderly being abused in nursing homes due to improper medical care. It is great that programs are trying to be put in place to cut down on medical malpractice lawsuits but what about just cutting down on the actual malpractice? If patients receive proper medical care, including checkups, treatments, evaluations and more, then we can worry less about lawsuits because the medical care will be better. Until medical errors are dramatically reduced and programs are put in place for more adequate medical care than people still need malpractice rights and lawyers to help them advocate for their rights to proper medical care. Tort reform may try to cut costs all it wants, but people still need their rights and one of these rights is their right to sue for medical malpractice. These rights are there to help those hurting.  Tort reform has only hurt more and not helped.
